By accessing and using the Share and Repair Network ("the Platform", "we", "our", "us"), you accept and agree to be bound by these Terms and Conditions of Use. If you do not agree to these terms, please do not use the Platform.

The Platform is currently in preview mode. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, and data loss may occur during this preview period.

2. Description of Service

The Share and Repair Network is a platform that connects:

  • Lending libraries and tool-sharing organizations
  • Repair cafés and repair services
  • Community groups focused on sharing and repair activities
  • Individuals seeking to participate in the sharing and repair economy

The Platform allows users to discover organizations, access resources, share information, and participate in community-driven repair and sharing initiatives.

3. User Accounts and Registration

3.1 Account Creation: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3.3 Account Termination: We reserve the right to suspend or terminate accounts that violate these terms or engage in inappropriate behavior.

3.4 Age Requirement: You must be at least 16 years old to create an account. Users under 18 should use the Platform under parental supervision.

4. User Content and Conduct

4.1 Your Content: You retain ownership of content you submit (organization profiles, resources, comments, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

4.2 Content Standards: You agree not to post content that:

  • Is false, misleading, or fraudulent
  • Violates intellectual property rights
  • Contains hate speech, harassment, or discrimination
  • Is pornographic, obscene, or sexually explicit
  • Promotes illegal activities or violence
  • Contains malware, viruses, or malicious code
  • Violates privacy rights or discloses personal information of others without consent

4.3 Content Moderation: We reserve the right to review, edit, or remove any content that violates these terms or that we deem inappropriate, without notice.

4.4 Organization Listings: Organizations listed on the Platform are responsible for the accuracy of their information. We do not endorse or verify organizations unless explicitly stated.

5. Resource Sharing and File Uploads

5.1 Uploaded Resources: When uploading files or sharing resources, you confirm that you have the right to share such materials and that they do not infringe on third-party rights.

5.2 File Restrictions: Uploaded files must not exceed 50MB and must be of accepted file types (PDF, Word documents, spreadsheets, images, videos, etc.). Files containing malicious code are prohibited.

5.3 Copyright Compliance: You must respect copyright laws. Do not upload copyrighted materials unless you own the rights or have explicit permission.

5.4 External Links: You may share external links, but you are responsible for the content of those links. We are not liable for third-party websites.

6. Privacy and Data Protection

6.1 Data Collection: We collect personal information as described in our Privacy Policy, including name, email address, location data, and usage information.

6.2 Data Usage: We use your data to provide services, improve the Platform, send notifications (which you can control), and facilitate connections within the sharing and repair community.

6.3 Data Sharing: We do not sell your personal information. We may share data with:

  • Organizations you choose to interact with
  • Service providers necessary for Platform operations
  • Law enforcement when legally required

7.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

7.3 Prohibited Uses: You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform without explicit written permission.

8. Third-Party Services and Links

The Platform may contain links to third-party websites, services, or resources. We are not responsible for the content, accuracy, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms.

We use third-party services including AWS (for storage), email providers, and mapping services. These services have their own terms and privacy policies.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Service: The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Endorsement: We do not endorse, verify, or guarantee the quality, safety, or legality of organizations, resources, or activities listed on the Platform. Users interact with organizations at their own risk.

9.3 Limitation of Liability: To the maximum extent permitted by law, Share and Repair Network, its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Service interruptions or data loss (especially during preview mode)
  • Actions or content of third parties or other users
  • Damages arising from your use or inability to use the Platform

9.4 Maximum Liability: In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed £100 GBP or the equivalent in your local currency.

10. Indemnification

You agree to indemnify, defend, and hold harmless Share and Repair Network and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform

  • Content you submit to the Platform

11.3 Jurisdiction: Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.4 EU Users: Nothing in these Terms affects your statutory rights as a consumer under EU or UK consumer protection laws.

12. Preview Mode and Beta Features

12.1 Preview Status: The Platform is currently in preview mode while we work with founding organizations. Features may change, and service interruptions may occur.

12.2 Data Loss Risk: During preview mode, data loss may occur. We recommend maintaining backups of important information. We are not liable for any data loss during this period.

12.3 No Service Level Agreement: We do not guarantee uptime or availability during preview mode.

12.4 Feedback: We welcome your feedback and ideas. By submitting feedback, you grant us the right to use it without compensation or attribution.

13. Email Communications and Notifications

13.1 Notification Preferences: You can control which email notifications you receive through your account settings. Types of notifications include library news, repair news, and platform updates.

13.2 Transactional Emails: Certain transactional emails (account verification, password resets, security alerts) cannot be opted out of as they are essential to the service.

13.3 Communication Standards: We will not spam you or share your email with third parties for marketing purposes.

14. Organizations and Groups

14.1 Organization Responsibility: Organizations and groups listed on the Platform are responsible for:

  • The accuracy of their information
  • Compliance with applicable laws and regulations
  • Their own activities and services
  • Managing their own liability and insurance

14.2 Verification: While we may verify certain organizations, inclusion on the Platform does not constitute endorsement or guarantee of quality or safety.

14.3 Removal Rights: We reserve the right to remove any organization or group from the Platform at our discretion, particularly if they violate these Terms or receive persistent complaints.

15. API Access and Automated Use

15.1 API Terms: If you access our API, you must comply with our API Terms of Service (if available) and these Terms.

15.2 Prohibited Automated Access: You may not use bots, scrapers, or automated tools to access the Platform without explicit permission. Excessive automated requests may result in account termination or IP blocking.

15.3 Rate Limits: We may implement rate limits on API or Platform usage to ensure service quality for all users.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or prominent notice on the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

17. Termination

17.1 Your Rights: You may terminate your account at any time by contacting us or using account deletion features in your settings.

17.2 Our Rights: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to provide notice when reasonable.

17.3 Effect of Termination: Upon termination, your right to use the Platform ceases immediately. We may delete your data in accordance with our data retention policies, but some information may remain in backups or as required by law.

18. Dispute Resolution

18.2 Mediation: Before pursuing litigation, parties agree to attempt mediation through a mutually agreed mediator in the UK.

18.3 Consumer Rights: Nothing in these Terms affects your statutory consumer rights or your right to take action in small claims court.

19. Severability and Waiver

19.1 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19.2 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20. Entire Agreement

These Terms, along with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Share and Repair Network regarding use of the Platform, superseding any prior agreements.
